Terms of Service
These terms govern your use of Fermata. By using Fermata, you agree to these terms. If you have questions, reach out anytime.
1. Who We Are
Fermata is a studio management platform for independent music teachers. Fermata is operated by Bradley Cofer ("we," "us," or "Fermata"). Our email is support@tryfermata.com.
2. Your Account
When you sign up, you're responsible for keeping your login credentials secure. You agree not to share your account with others or let unauthorized people access your studio data. We reserve the right to suspend or terminate accounts that violate these terms.
You must be at least 18 years old to create an account.
3. The 14-Day Free Trial
No credit card is required to start your free trial. You get full access to Fermata for 14 days. At the end of the trial, you'll be prompted to subscribe to continue. If you don't subscribe, your account goes into a read-only state — your data stays safe, you just can't make changes.
If we ever change the trial duration, we'll give you at least 7 days' notice before the change takes effect.
4. Subscription & Billing
After your trial, you'll be on a monthly subscription at the rate shown at the time you sign up. Pricing is per studio — one account, one studio, one price.
- Early Adopter rate: $19/month (locked in for life if you sign up during the early adopter period)
- Standard rate: $24/month (applies to new signups after the first 100 users)
All prices are in USD and exclude any applicable taxes. You're responsible for any taxes in your jurisdiction.
Payments are processed securely by Stripe. We never see or store your card details.
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — we don't prorate or refund partial months.
5. What Fermata Manages for You
Fermata automates scheduling, billing, student tracking, and parent communication for music teachers. This includes:
- Sending lesson reminders and parent messages
- Generating invoices and managing billing records
- Tracking student progress and lesson history
- Managing your teacher calendar and availability
- Generating smart progress notes
You own all student data and parent contact information you input. Fermata processes this data on your behalf to deliver the service.
6. What You Agree Not to Do
You agree not to use Fermata to:
- Violate any applicable law or regulation
- Process data for any purpose that conflicts with FERPA or similar student privacy laws in your jurisdiction
- Upload viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Resell or redistribute the service without our written permission
- Use automated tools to scrape or copy content from the platform
7. Your Data & Privacy
We take your privacy seriously. We collect only what we need to run the service. We never sell, rent, or share your personal data or your students' data with advertisers or third parties for their own purposes. See our Privacy Policy for full details.
You retain full ownership of all data you store in Fermata. You can export or delete your data at any time by contacting us.
8. Availability
We aim for 99% uptime but don't guarantee uninterrupted service. Planned maintenance will be announced at least 48 hours in advance when possible. We aren't liable for temporary outages beyond our control.
9. Intellectual Property
The Fermata platform, design, logo, and all original content are owned by Fermata. You retain all rights to the content you create (student notes, invoices, messages) — we just get a license to process and deliver it.
You may not copy, reproduce, or mirror Fermata's branding or design without written permission.
10. Limitation of Liability
To the maximum extent permitted by law, Fermata is provided "as is" without warranties of any kind. We aren't liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business resulting from your use of the service
- Actions taken by teachers using the platform — you're responsible for how you manage your studio and student relationships
Our total liability for any claim is capped at the fees you paid us in the 12 months before the claim arose.
11. Termination
You can stop using Fermata at any time by canceling your subscription and deleting your account. We can suspend or terminate accounts that violate these terms or applicable law.
After termination, we retain your data for 90 days before permanent deletion — you can request export during this window.
12. Changes to These Terms
We may update these terms occasionally. If the changes are material, we'll notify you by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated terms.
13. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States.
